Terms of Service

These terms of service govern your use of the 4D Restoration website (4drestoration.com) and any restoration services provided by 4D Restoration. By using this website or hiring me for restoration work, you agree to these terms.

I keep this straightforward because I believe clear expectations up front prevent problems later. If anything in here doesn't make sense, call me at 405-896-9088 and I'll walk you through it.

1. Scope of Services

4D Restoration provides mitigation services only. Mitigation includes water extraction, structural drying, mold remediation, fire and smoke damage cleanup, odor removal, asbestos abatement, lead paint abatement, trauma cleanup, content cleaning, and related emergency stabilization work.

What mitigation means: I stop the damage from getting worse, remove contaminants, dry the structure, and return your property to a clean, stable condition ready for reconstruction.

What I do NOT do: Reconstruction, general contracting, remodeling, or structural rebuilding. When reconstruction is needed, I refer you to or coordinate with licensed general contractors. I do not perform electrical, plumbing, HVAC, or structural carpentry work.

The specific scope of work for your project is defined during the initial assessment and documented in writing. If hidden damage or conditions are discovered during the project that expand the scope, I will notify you and your insurance carrier before proceeding with additional work.

2. Service Area

4D Restoration's primary service area covers the Oklahoma City metropolitan area within approximately 45 miles of Oklahoma City. This includes Edmond, Norman, Moore, Yukon, Midwest City, Del City, and surrounding communities. I do accept projects outside this radius — additional mileage charges may apply for travel beyond the primary service area.

3. Emergency Services and Authorization

Restoration emergencies require fast action. When you contact me for emergency service:

  • I will respond and arrive on-site as quickly as possible, typically within 60–90 minutes during regular business hours.
  • Emergency work (water extraction, board-up, tarping, containment) may begin immediately upon your verbal authorization to prevent further damage to your property.
  • If you are not present at the property during an emergency, the property manager, tenant, insurance adjuster, or other authorized representative may grant access and authorization on your behalf.
  • Any verbal authorization will be followed up with written documentation.

If emergency stabilization is needed and you cannot be reached, I will take reasonable steps to prevent further damage to your property and document all actions taken.

4. Property Access and Site Conditions

To perform restoration services, I need access to your property. You agree to:

  • Provide timely access to affected areas at scheduled times. If access is denied or delayed at a scheduled appointment, a trip fee may apply.
  • Make utilities available (electricity, water, gas) at your expense, as these are required for drying equipment, air scrubbers, and other restoration equipment to operate.
  • Secure valuables and personal items in unaffected areas before work begins. I am not responsible for items left in the work zone unless they are part of a documented contents pack-out.
  • Keep children and pets away from active work areas for safety reasons. Restoration sites may involve standing water, exposed materials, mold, asbestos, chemical treatments, or heavy equipment.
  • Disclose known hazards including pre-existing mold, asbestos, lead paint, structural damage, pest infestations, or any condition that could affect worker safety or project scope.

I will place equipment (dehumidifiers, air movers, air scrubbers, negative air machines, containment barriers) on your property as needed. All equipment will be removed upon project completion.

5. Insurance Coordination

4D Restoration works with all major insurance carriers in Oklahoma. Here's how it works:

  • I assist with your claim by documenting damage, providing detailed scopes, moisture logs, photos, narratives, and completion reports to your insurance company.
  • I do not guarantee insurance coverage. Coverage decisions are made solely by your insurance carrier based on your policy terms. I have no control over what your insurer approves, denies, or pays.
  • I communicate directly with your adjuster when authorized by you, but the contractual relationship is between you and your insurer. You are ultimately responsible for your policy obligations.
  • You are responsible for payment. If your insurance carrier denies your claim, reduces payment, or delays payment, you remain responsible for the balance of services rendered. My agreement is with you, not your insurance company.
  • Deductible: Your insurance deductible is your responsibility and is due at the time of service or upon completion, depending on the arrangement.

In Oklahoma, the choice of restoration company is always yours — not your insurer's. You have the right to choose who works on your property.

6. Estimates, Pricing, and Payment

  • Estimates are not final prices. Initial assessments provide a scope and estimated cost based on visible conditions. Hidden damage (e.g., moisture behind walls, mold in cavities, structural issues) discovered during the project may increase the final cost. I will notify you before proceeding with additional work.
  • Change orders: If the scope of work changes due to hidden conditions, additional damage, or your request, a change order will be documented and communicated to you and your insurance carrier.
  • Payment is due upon completion of services unless other arrangements are made in writing. For larger projects, progress payments may be required.
  • Accepted payment methods: Check, credit card, insurance direct pay (where applicable), and other methods as agreed.
  • Late payment: Accounts not paid within 30 days of invoice date may be subject to a late fee of 1.5% per month on the outstanding balance. If collection action is necessary, you agree to pay reasonable attorney fees and collection costs.

7. Service Documentation

All restoration work is documented according to IICRC standards. This documentation includes:

  • Timestamped photos and videos of property conditions before, during, and after restoration
  • Daily moisture readings organized by room or zone
  • Equipment placement records and runtime logs
  • Written narratives and room-by-room scopes
  • Contents inventory (if applicable)
  • Completion reports and clearance verification

This documentation is your record of the work performed. It is shared with you and, with your authorization, your insurance carrier. I retain this documentation for a minimum of 7 years per my data retention policy.

8. Warranties and Limitations

  • Workmanship warranty: I stand behind the quality of my work. If a restoration deficiency is discovered that is directly attributable to my workmanship, I will correct it at no additional charge within a reasonable timeframe. Contact me promptly if you identify an issue.
  • No guarantee against future occurrence: Restoration addresses existing damage. I cannot guarantee that water damage, mold, fire, or other conditions will not recur, particularly if the underlying cause (e.g., a roof leak, plumbing issue, or HVAC problem) is not repaired. Addressing root causes is typically reconstruction work, which is outside my scope.
  • Exclusions: This warranty does not cover pre-existing conditions, normal wear and tear, damage caused by events occurring after project completion, failure to maintain the property, or issues caused by third parties.

9. Limitation of Liability

To the fullest extent permitted by Oklahoma law:

  • 4D Restoration's total liability for any claim arising from services provided shall not exceed the total amount paid by you for the specific project giving rise to the claim.
  • I am not liable for indirect, incidental, or consequential damages including but not limited to: lost profits, lost rental income, diminished property value, business interruption, emotional distress, or costs of alternative housing — except where such limitation is prohibited by law.
  • I am not liable for delays caused by events beyond my reasonable control, including severe weather, power outages, supply chain disruptions, government orders, or acts of God.
  • I am not responsible for pre-existing conditions that are not caused by or related to the damage I was hired to remediate.

Nothing in this section limits liability for willful misconduct, gross negligence, or bodily injury caused by our actions.

10. Your Responsibilities

As the property owner or authorized representative, you are responsible for:

  • Providing accurate and complete information about the damage and property conditions
  • Granting timely access to the property and maintaining utility service during the project
  • Communicating with your insurance company regarding your claim
  • Securing personal items not included in the restoration scope
  • Paying for services rendered as outlined in Section 6
  • Following any instructions provided for your safety or the safety of occupants during and after restoration (e.g., not entering containment areas, running equipment as directed)
  • Addressing root causes of damage (plumbing repairs, roof repairs, HVAC maintenance) through appropriate contractors — this is reconstruction, which I do not perform

11. Cancellation and Termination

  • Before work begins: You may cancel services at any time before work begins with no penalty, provided equipment has not been mobilized to your location.
  • After work begins: If you cancel during an active project, you are responsible for payment of all work performed and equipment deployed up to the point of cancellation.
  • I may suspend or stop work if: site conditions present a safety hazard that cannot be mitigated; you fail to provide access or utilities; payment obligations are not met; or you direct me to perform work that would violate IICRC standards, OSHA regulations, or applicable law.

12. Indemnification

You agree to indemnify and hold harmless 4D Restoration, Phil Sheridan, and any employees or subcontractors from claims, damages, or expenses arising from: (a) your breach of these terms; (b) your failure to disclose known hazards or pre-existing conditions; (c) actions of third parties on your property during or after restoration; or (d) your failure to address root causes of damage after restoration is complete.

13. Dispute Resolution

If a dispute arises regarding services provided by 4D Restoration:

  1. Contact me first. Call 405-896-9088 or email psheridan@4drestoration.com. Most issues can be resolved with a conversation.
  2. Mediation. If direct resolution fails, either party may request non-binding mediation through a mutually agreed mediator in Oklahoma County.
  3. Legal proceedings. If mediation is unsuccessful, disputes shall be resolved in the courts of Oklahoma County, Oklahoma, under Oklahoma law.

Each party shall bear its own attorney fees and costs unless otherwise awarded by the court.

14. Website Terms

  • Content ownership: All text, images, design, code, and other content on 4drestoration.com is the property of 4D Restoration unless otherwise noted.
  • Accuracy: I make reasonable efforts to keep website content accurate and current. However, information on this website does not constitute a guarantee of service availability, pricing, or specific outcomes.
  • Third-party links: This website contains links to third-party websites. I am not responsible for the content, accuracy, or privacy practices of external sites.
  • Prohibited use: You may not use this website in any way that could damage, disable, or impair the site, or attempt to gain unauthorized access to any part of it.

15. Governing Law

These terms of service are governed by the laws of the State of Oklahoma. Any legal action arising from these terms shall be filed in the appropriate state or federal court in Oklahoma County, Oklahoma.

16. Changes to These Terms

I may update these terms as my business practices evolve or as required by law. Updated terms will be posted on this page with a revised "Last Updated" date. Continued use of this website or services after changes are posted constitutes acceptance of the updated terms.
